Terms and Conditions: The following terms and conditions are a legally binding contract between Produced By Eric (“we,” “us,” or “our”) and the customer/client (“you”, “your”). Please read them carefully.
Acceptance of Terms: Your purchase of products and services from us constitutes your acceptance of these terms and conditions.
Legally Binding Agreement: By completing your purchase, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions. This agreement is legally binding between you and us.
Modification of Terms: We reserve the right to modify or update these terms and conditions. Customers will be notified of any changes, and continued use of our services after notification constitutes acceptance of the modified terms.
Consumer Protections: All purchases made through our website are subject to the rights and guarantees provided under the Australian Consumer Law. Nothing in these terms and conditions is intended to exclude, restrict, or modify any rights you may have under applicable law.
Governing Law: This agreement is governed by the laws of Australia, and any disputes will be resolved in accordance with the laws applicable in that jurisdiction.
Confidentiality: We respect the confidentiality of the material you provide for receipt of our products and services, and will not disclose or share it with third parties without your consent.
Indemnity: You agree to indemnify and hold us harmless from any claims, losses, or damages arising out of your receipt and use of our products and services.
Data Security and Privacy: Customer data, including files provided for advertised services, will be handled with confidentiality and stored securely. Our commitment to customer privacy and data security is outlined in our privacy policy.
Force Majeure: Neither party will be held liable for any failure to perform its obligations due to unforeseen circumstances beyond their control, such as natural disasters or other force majeure events.
Description of Services: The products and services advertised on our website accurately represent the product or service that will be provided. The products and services provided will be delivered as agreed upon at the point of purchase or as stated elsewhere. This includes, but is not limited to, the format of files delivered upon completion of work.
Delivery of Completed Work: Upon completion of services, the final files will be delivered to you through our website. You will receive notification of the completion and instructions on how to download the files.
Credit: Eric Shing-Hei Yeung must be credited according to the product or service provided, including (but not limited to) the following examples. If you bought beats or instrumentals from us, Eric Shing-Hei Yeung must be credited as the beat-maker; if you hired us for music production services, Eric Shing-Hei Yeung must be credited as the producer (and co-writer if applicable); and if you hired us for mixing and mastering, Eric Shing-Hei Yeung must be credited as the mixing engineer and the mastering engineer; etc.
Payment Terms: Payments are due at the point of purchase. In the case of special (e.g., larger) projects, pay-as-you-go options may be available and offered at the point of purchase. Accepted payment methods include: Credit or debit cards, PayPal, and others. Any completed files or work will be withheld until full payment is received. For all products and services on sale or under some other promotion, full payment is due at the point of purchase.
Cancellations and Refund Policy: For the purchase of products (e.g., beats or instrumentals) or services in which work has already been undertaken (e.g., offline mixing and/or mastering services), refunds are generally not provided. However, in exceptional circumstances (e.g., where the delivered file is corrupted and cannot be retrieved), we will assess the situation on a case-by-case basis and determine whether a refund is appropriate and warranted, and we may subsequently provide a refund at our discretion. For bookings of appointments, refunds may be provided should the booking be cancelled more than 24 hours prior to the scheduled appointment time. Refunds will not be provided if the bookings are cancelled 24 hours or less than 24 hours prior to the scheduled appointment time, nor will they be provided should you fail to arrive at the appointment at the scheduled time. Refunds are not available for products and services on sale or under any other promotion except for in exceptional circumstances, in which case, they will be provided at our discretion. Please contact us here within 14 days of receiving the product or service to discuss any issues that may arise.
Intellectual Property: The final delivered products and services remain the intellectual property of us until full payment is received. Upon payment, you acquire the full and necessary rights to use the files for your intended purposes, including for commercial use. We reserve the right to retain a copy of the master files and publish them as part of our portfolio for the purposes of showcasing our work to customers, but not to sell or otherwise use on a commercial basis.
License for Promotional Use: We reserve the right to use any or all of the final product for promotional purposes, such as showcasing a portfolio on the website or in marketing materials, but not limited to these examples.
Communication and Support: Customers can contact us for inquiries, support, or issue resolution here. By proceeding with your purchase, you provide us with permission to contact you regarding your purchase, through channels acquired by us (e.g., the email address and/or telephone number provided to us).
Quality Assurance: We are dedicated to delivering high-quality services. Our internal quality control measures ensure that customers receive the best results.
Turnaround Time: We commit to completing orders in a timely manner. Customers will be notified of any delays.
Dispute Resolution: Disputes will be resolved through negotiation, mediation, or arbitration before resorting to legal action. Any legal action will be subject to the laws of Australia.
Termination of Services: Either party may terminate the services for any reason; however, full payment (or payment pro rata to the services already provided) is due immediately. If services are terminated before any work has begun, the customer will be provided with a full refund.
Termination of Customer Account: We reserve the right to terminate a customer’s account should any of these terms be breached, or if the customer’s actions are deemed to put our reputation at risk. In such a case, the customer will also be refused future service, and legal action may be taken.
Feedback, Reviews, and Testimonials: Customers are encouraged to provide feedback, reviews, or testimonials by logging into their account. Feedback, reviews, and testimonials will be published on our website (with the option to remain anonymous). These can and will be used for marketing purposes.
Slander Protection: Dissemination of false information or defamatory statements about us on public platforms is strictly prohibited, and will result in the termination of the customer’s account. Legal action may be taken for intentionally damaging statements. We encourage open dialogue through designated communication channels to address concerns.
Revisions and Edits: Customers are entitled to one free revision to the delivered files. Additional revisions may incur extra fees, which will be communicated and agreed upon before implementation, as well as being offered at the point of purchase of the original service. Free revisions are not provided to products and services that are on sale or under some other promotion.
Non-Disclosure Agreement (NDA): If required, customers may be subject to additional confidentiality agreements or non-disclosure requirements, especially if the material provided is sensitive or confidential.
Technical Specifications: Customers must adhere to specified technical specifications for the files provided to us for the provision of services, including preferred file formats, bit-depth, sample rates, etc.
Communication Timelines: We commit to responding to customer inquiries within 14 days. Communication timelines will be adhered to, with any delays communicated to customers in advance.
Governing Language: These terms and conditions are governed by and construed in accordance with the English language. In case of any discrepancies or conflicts in interpretation, the English version shall prevail.
Ownership of Source Files: Customers will have access to the source files used in the provision of services upon request, in addition to the final files delivered, so long as full payment has been received by us.
Client Responsibilities: Customers must provide clear, accurate, truthful, and relevant information pertaining to the product or service they are purchasing at the point of purchase.
Legal Disclaimer Regarding Sample Usage: Customers are solely responsible for ensuring legal clearance and licensing of all third-party samples or copyrighted material used in their music projects. We bear no liability for any unauthorised use, and customers are advised to comply with copyright laws, obtain relevant and necessary permissions, and verify legality. We reserve the right to terminate projects involving potential legal issues without liability. It is the customer’s responsibility to seek legal advice and adhere to copyright laws.
Additional Services and Fees: Any additional products and services beyond the scope of the initial agreement will be available on request at and after the point of purchase, as will their respective associated fees.
Regulatory Compliance: We affirm our commitment to complying with relevant laws and regulations governing the provision of our products and services.
